Troopers and civilian employees of the Massachusetts Department of State Police (MSP) are fighting back against the Department's mandatory COVID-19 vaccination policy – only this time, the fight is in federal court. On November 23, 2022, three State Troopers filed the first of multiple lawsuits against the MSP after the Department violated their fundamental right to freely exercise their religion and gave them an ultimatum: get vaccinated or lose your job.

Some troopers and employees have been on suspension without pay for over a year now all because they did not comply with MSP's vaccine mandate. Some were fired, some were forced to resign after lengthy, punitive, unpaid suspensions. Unfortunately, this is all too common. That's why it's time to put an end to overreach and the violation of constitutionally protected rights.

UPDATE: 8/4/23

On 4 August 2023, six Troopers recognized for their sincerely held beliefs but denied accommodations were determined to have been wrongfully suspended without pay and their former employer was ordered to offer them their careers back.

The fight continues for those dishonorably discharged, forced into resignations and unplanned retirements for defending their personal beliefs.

The goal is not only to restore sworn and unsworn members harmed by the mandate but to build a precedence that prevents anyone, from any profession, having to choose between their convictions and their career.

UPDATE: 12/18/23

The states motion to dismiss was denied and the First Circuit court is scheduling this case for trial.

UPDATE 8/20/24:

On 7 August 2024, MSP and the Troopers denied their Constitutional rights and Dishonorably Discharged or forced from their careers in the MSP by Mandate 595 were to meet and engage in good faith mediation to avoid a trial.

The MSP declined to meet with the Troopers and their counsel to discuss a reasonable solution, instead the State has chosen to engage former employees with good records in the court room.

UPDATE 3/4/25:

"This case is continuing with the State having named its expert witness and the Medical Freedom Team being reasonable and accommodating the states counsel while on family leave.

The next stage on the path to trial will be for the Medical Freedom team to engage professional witnesses and actuaries to testify on their behalf.

The costs will be significant and all support is appreciated as it directly contributes to eventual success in this case.

The next scheduling meetings will be in May and September.

Justice moves slow and methodically but toward the day when the idea of "medical mandate" is repudiated and our kids won't ever be subject to this process."
